Auction Terms, Conditions and General Information

REAL  ESTATE (sells first)

Buyer’s Premium:  A 10% buyer’s premium will be added to the high bid to determine the final contract selling price.

Down Payment:  The buyer shall make a down payment of $10,000 immediately following the auction.  The down payment may be made by certified check or a good personal check.

Closing:  Closing shall occur on or before September 12, 2006.

Inspections:  The real estate will be open for inspection Sunday, July 30th, from 2-5 PM and prior to auction.

Conditions of Sale:  The property is being sold in “as is” condition with no conditions or contingencies of any kind.  Any home inspections, etc. welcome but should be completed prior to auction and is not a condition of sale.

Broker/Agent Participation Welcome: A Broker or agent whose client is the buyer of the real estate may be entitled to a  2% broker participation fee.  Agents must register their clients by 4:00 PM Friday, August 4th.  Brokers and agents may obtain the registration from the web site (click here) or by calling the auctioneer or agent.

PERSONAL PROPERTY (sells following real estate)

PaymentAll purchases must be paid for on day of sale cash, good personal check with valid ID, Mastercard, or VISA. Out of state checks over $1,000 require bank letter of guarantee or equivalent suitable to auctioneer.

Vehicles: Vehicles shall be paid for in full on day of sale by cash or good personal check.  Possession will be transferred to buyer upon transfer of title and receipt of cash equivalent funds.  Transfer must be within 5 working days.

No buyer’s premium: No buyer’s premium will be used on personal property.

Inspection:  Property may be inspected beginning 8:30 am on day of auction.

As is-where is:All property is sold “as is-where is” with no guarantees or warranties regarding condition or purpose. 

Removal of PurchasesAll property should be removed by 5:00 PM on day of auction or later by appointment with Auctioneer. 

Sales TaxAll purchases are subject to Kentucky 6% sales tax unless proper documentation is presented to Auctioneer on auction day showing exemption from such tax. 

Auction Location:  From I-264 go east on Shelbyville Rd. (Hwy. 60), just past Oxmoor Mall turn left on Whipps Mill Rd. (Hwy. 1699).  From I-64, go north on Hurstbourne Ln., left on Shelbyville Rd., go 6/10 mile, right on N. Chadwick, right on Whipps Mill Rd.
