TERMS AND CONDITIONS OF SALE OF FIREARMS

 

1.     Wardlow Auctions Inc. is acting only as the agent for the Seller.

2. All guns are sold “as is” with no guarantees or warranties as to condition or fit for purpose. 

3. Descriptions of the firearms are provided as best as possible based on input from various parties and review by the
Auctioneer, but are not warranted.  In the event you disagree with the description provided, you should bid accordingly.  The lot number assigned to a gun is for ease of identification only.  We will not necessarily sell the guns in sequential order.

4.    All purchases must be paid for in full today by cash, official check, good personal check (out of state checks $1000 or      more require a bank letter of guarantee), Mastercard or VISA.

5.    “Straw Buying” (buying for someone else) is a federal felony and will not be recognized nor accepted at this auction or at

        the transferring FFL dealer.

6.    The following sale and transfer procedures are established based on: 1) all applicable State and Federal laws governing

        the sale and transfer of firearms, and 2) efforts to reduce liability to the selling parties by ensuring that the firearms are 

        sold only to qualified individuals.

       A.  Regarding the sale of handguns

                 a) Buyers must be at least 21 years old.

                 b) The transfer of all handguns will go through a Federal Firearms Licensed (FFL) Dealer. 

                 c) All handgun buyers will be required to complete ATF form 4473 and be subject to a background check

                 through the FBI’s National Crime Information Center (NCIC).

      B.  Regarding the sale of shotguns and rifles:  a)  Buyers must be at least 18 years old; 

                 b)  For Kentucky residents — Upon completion of ATF form 4473 the guns can be transferred to the buyer at the

                 auction premises. 

      C.  For out of state buyers of handguns and long guns. The guns must be transferred through a FFL dealer and buyers                  will be required to complete ATF form 4473.  All handguns must be sent to and transferred through an FFL dealer                  in the state of the buyer’s residence.   Depending on applicable State laws, long guns may be picked up at the                         local FFL dealer’s place of business or be sent to a FFL dealer in the state of the buyers residence.  For out of                  state shipping, buyers must contact their FFL dealer to have them forward a copy of their license to Shooters                  Supply Co.  The buyer will be responsible for payment of all shipping costs, receiving FFL dealer transfer fees,                  and taxes. Though not required, out of state buyers are encouraged to make pre-arrangements with an FFL                  dealer in their state prior to the auction.

       D.  FFL Dealers:  FFL dealers are welcome.  Please bring a copy of your FFL license for our records. 

       For all transfers going through the FFL dealer, all buyers must have a valid, current, drivers license with photo ID.

7.   The following area Federal FFL dealer has agreed to assist with the transfer. 

                 1) Shooter’s Supply Co, 8003-11 Vine Crest Ave., Louisville, KY 40222 (Lyndon area)

                 Ph. 327-6827              Store hours:  M-F 10-6; Sat. 10-4; Sun. 12-6

                 Charge for processing the transfer:  $25 for the first gun and $20 per additional gun.

                 Following the auction, the guns requiring FFL processing will be taken to Shooter’s Supply for processing.  Upon

                  receiving approval of the NCIC background check, buyers can take possession of their gun immediately.   A map                  to Shooters Supply is available at the cashier table.  Shooters Supply reserves the right to refuse transfer of any                  firearm to any individual if there is any question of the legality of the transaction.

                 Shooters Supply Co. shall be held free from any liability regarding condition of firearm upon receipt.  

                

When you go to pick up your gun, you must take your invoice with you to show that you are the buyer and that you already paid the sales tax.

 

8.    If you are a convicted felon, drug abuser, alcohol abuser, mentally incompetent, have been convicted of a crime of

       domestic violence, have an existing restraining order, or under the age of 18 years old for long guns and 21 years old for 

       handguns, don’t even think about bidding. 

9.    In the event that the buyer does not pass the NCIC background check and cannot take possession of the gun, we will

       refund the buyer 75% of the purchase price through Saturday, March 24, 2007.  After that time there will be no refunds

 

10. We appreciate your patience in cooperating with these legalities.  It is our intent to ensure that these firearms are sold to

       persons who can legally own them and that there is documentation of transfer of ownership and possession  from the

       seller to the buyer.
